Terms and conditions (Terms)

1. Introduction

Your use of the Employee Mobile App (“App”) is strictly subject to these Terms.

These Terms form an agreement between you and us, so please make sure that you understand all of them.

This Employee Mobile App is provided by The Standard Bank of South Africa Limited to enable you to access services offered by the relevant Standard Bank Group company that you are employed with (“your Employer”). The laws of the jurisdiction from or in which the services are provided to you apply accordingly.

Important clauses, which may limit our responsibility or involve some risk for you, will be in bold and italics or highlighted. You must pay special attention to these clauses.

 

2. Definitions

We have defined some words for consistency. These words will begin with a capital letter, where indicated. Singular words include the plural and the other way around. 

Word Meaning
Access Codes Any of your secret numbers used to access our employment management facilities, including your login details, passwords, Windows NT UserID.
Email address Your Standard Bank email address which is linked to your Windows Network UserID.
Profile Your employee profile on Standard Bank’s systems which you access by way of your Email address and/or Windows NT UserID and unique password.
App Store Your Device’s application store (provided by Apple or Google) from which you download the App.
Employee Mobile App/the App The Human Capital Application through which you access SAP HCM Employee Mobile.
SAP HCM Employee Mobile The SAP Human Capital Management Employee mobile service provided through the App and as updated from time to time.
Device The device you use to access the App, namely your smartphone and/or tablet.
General terms of employment The terms of employment between you and Standard Bank
Group Our affiliates, associates, subsidiaries and divisions together with our holding company and its affiliates, associates, subsidiaries and divisions.
Intellectual Property Without limitation, is all inventions, specifications, patents, designs, trademarks, service marks, trade names and all goodwill associated with such inventions, patents, designs, trademarks, service marks, trade names; copyright, including all copyright in any logos, devices, designs, multimedia works and computer software programs (in both source and object code form, and including any programmers’ or developers’ notes, flow charts, memoranda and design documents); rights protecting goodwill and reputation; proprietary material, know-how, ideas, concepts, trade secrets, methods, techniques, graphics; schematics; marketing; sales and user data; domain names and URLs; databases and rights in databases, confidential information and all other intellectual property rights and rights of a similar character whether registered or capable of registration, rights in the nature of any of the above items whether registered or unregistered in any country or jurisdiction and all applications and rights to apply for protection of any of the same.
Intellectual Property Rights All rights in and to Intellectual Property.
Personal Information Information about an identifiable, natural or juristic person, including but not limited to, information about race, gender, marital status, nationality, ethnic or social origin, sexual orientation, age, physical or mental health, religion, belief, disability, language, birth, education, identity number, telephone number, email, postal or street address, biometric information and financial, criminal or employment history as well as correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence.
Process Any operation or activity, whether automated or not, concerning Personal Information, including: collection; receipt; recording; organisation; collation; storage; updating or modification; retrieval; alteration; consultation; use; dissemination by means of transmission, distribution or making available in any other form; merging, linking as well as blocking, degradation, erasure or destruction of information. Processing will have a similar meaning. 
Instruction Any transaction/action done on your Profile using the App, including viewing of salary statements, requesting leave or updating personal information. Instruct has a similar meaning.
Standard Bank, we, us, our The Standard Bank of South Africa Limited (Registration number 1962/000738/06) and its successors or assigns.
you or your An employee of the Standard Bank of South Africa Limited.
Mobile network operator The company providing mobile services to you via a contract or pay-as-you-go services. 
SAP SAP (Systems, Applications and Products), a German-based European multinational software corporation that makes enterprise software to manage business operations and customer relations.
Windows NT UserID Your personnel ID provided by us, which may be a combination of letters and numbers

 

3. Registration

You do not have to register to use the App. If you are an employee of The Standard Bank of South Africa Limited you can start using the App as soon as you’ve downloaded it from the App Store. You will need to use your valid Standard Bank email address and your Standard Bank network (NT) password applicable at the time. 

4. Using the App

You should only use the latest version of the App. The App Store will notify you of any updates/upgrades that are available to you. If you do not install the latest version, the App may not function correctly and you may experience security and/or data flaws, for which we will not be liable under any circumstances. 

5. Fees and Costs

Standard data costs will be charged by your mobile network operator when you download the App and use the App on an ongoing basis. 

6. Instructions through the App

6.1 All Instructions are subject to your General Terms of Employment.
6.2 We are not responsible for any loss you suffer should you enter incorrect details or Instructions.
6.3

Interruptions

Should the App time-out or any other technical error or interruption occur while you are using the App, you should log-in again and double check whether the Instruction you entered during the previous session was confirmed as received. 

 

 7. Warranty by you

You represent and warrant that before using the App, you have read, understood and agreed to these Terms including the Human Capital Privacy Statement which can be viewed at: Privacy Notice and Legal Disclaimer (for Standard bank employees only) and forms part of these Terms. You further agree and understand that you are subject to and must comply with the Group’s applicable policies. Non-Compliance with such polices may result in disciplinary action being taken against you, including termination of employment. 

 


8. SAP HCM Employee Mobile Security

8.1 You must always look after your Access Codes and keep them secret and safe to prevent other persons from using them. If you do not, you give up any claim you may have against us for any loss or damage you may suffer because you have not kept them safe. 
8.2 If your Device is lost or stolen, it is advisable to change your Standard Bank network (NT) password, to prevent unlawful access to Standard Bank systems. 

 

9. Software and hardware

9.1 You must use software and hardware suitable for the App. If you do not, the App service on your Device may not work properly.
9.2 You acknowledge and agree that:
9.2.1 to the maximum extent allowed by law, the App Store does not give or enter into any warranty, condition or other term in relation to the App and will not be liable to you for any claims, losses, costs or expenses of whatever nature in relation to the App or as a result of you or anyone else using the App or relying on any of its content; and
9.2.2 In the event of any claim by a third party that your possession or use (in line with the Terms) of the App infringes any Intellectual Property Rights, the App Store will not be liable to you in relation to that claim.


 

10.  Disclaimers


Your use of the App is dependent on factors beyond our control, such as your network’s coverage or availability, your Internet Service Provider’s availability or your Device’s capability and capacity. We are not liable for any loss or damages you may suffer if a factor beyond our control arises and you cannot access the App.

 

11. Data protection

11.1 We may, and you expressly consent to, the collecting and Processing of your Personal Information by us to open, administer your Profile; provide any combination of services, analysis, advice or intermediary service linked to your Profile; monitor and analyse the conduct on your Profile and the App for fraud, compliance and other risk-related purposes; carry out statistical and other analyses to identify trends; and develop new employee services.
11.2 These terms must be read with the Human Capital privacy statement referred to in 7 above.
